THE CONTEST POLICY
1. The Win Whittaker’s contest (the Contest) is run by J H Whittaker & Sons Limited (Whittaker’s). Whittaker’s can be contacted in relation to this Contest at our offices at 24 Mohuia Crescent, Elsdon, Porirua, by phone on (04) 237 5021, or by email at shop@whittakers.co.nz.
2. The Contest will begin on the date that the first entry is submitted and accepted by Whittaker’s and will continue until Whittaker’s, in its sole discretion and without notice, terminates the Contest (the Contest Period).
3. The Contest will consist of a website form submission (each an Entry) during the Contest Period.
4. During the Contest Period Whittaker’s will select a winner or winners (at Whittaker’s discretion) for each Form (a Winner) from Entries received during the period for which Whittaker's makes the website form available.
Entry
5. The Contest is open to any person who is (both at the time of entry and at the time the Entry they have submitted is judged) resident in New Zealand, not an employee of Whittaker’s or any of its associated agencies or suppliers and who submits an Entry in accordance with these Terms and Conditions of Entry (a Contestant, you, your).
6. To enter, a Contestant must:
a. provide his or her full and correct name, email address and physical address;
b. agree to be bound by these Terms and Conditions of Entry;
c. follow the instructions of the Contest application; and
d. submit an answer to a question (an Entry).
7. A Contestant can only submit a single Entry to any Form.
Prizes
8. Each Winner will win a prize for the applicable Form, as announced or amended by Whittaker’s from time to time in its sole discretion.
9. Each Winner will be drawn by Whittaker’s from those Entries that answer all questions in the Form. No correspondence will be entered into.
10. The first 10 eligible winners drawn will each win a prize of 1,000 Airpoints™ Dollars to be used on New Zealand domestic flights. There are 10 prizes of 1,000 Airpoints™ Dollars to be won. The total prize pool is valued at 10,000 Airpoints™ Dollars.
11. Airpoints™ terms and conditions apply.
12. The Winners may not be notified, but instead any physical prize may just be sent to the physical address they provide when entering the Contest. You consent to your name being used for promotional purposes in relation to the Contest if you are a Winner.
Privacy
13. Whittaker’s takes its privacy obligations seriously and we refer you to our privacy policy for this Contest which you can find in the column alongside this policy.
14. In entering this Contest you are providing your personal information to Whittaker’s, and not to Facebook.
General
15. By entering the Contest you agree to be bound by these Terms and Conditions of Entry.
16. Prizes cannot be exchanged or redeemed for cash.
17. The Contest and these Terms and Conditions of Entry will be governed by New Zealand law.
18. Whittaker’s may vary these Terms and Conditions of Entry and may terminate, suspend, modify or cancel the Contest, the Form, or the prizes at any time without notice.
19. To the extent permitted by law, Whittaker’s will not be liable to you for any loss or damage, however caused, arising out of your participation in the Contest. To the extent that Whittaker’s cannot disclaim its liability you agree that Whittaker’s liability will in any case be limited to the value of the prize awarded to each Winner.
20. To the extent permitted by law, Whittaker’s will not be liable for any damage caused, whether by heat or temperature, to any prize while in transit to any prizewinning Contestant.
21. You acknowledge that the Contest is not sponsored, endorsed, administered by, or associated with Facebook and that Facebook has no liability to you in relation to the Contest. You agree to fully release Facebook from any and all liability in relation to your participation in this Contest.

WHITTAKER’S CONTEST PRIVACY POLICY
1. J H Whittaker & Sons Limited (Whittaker’s, we, us, our) is committed to protecting your personal information.
2. This Privacy Policy sets out how we handle your personal information that we may collect when you enter our Win Whittaker’s contest (the Contest).
Information we collect and use
3. When you enter the Contest, we will collect your name and your email address details so we know who you are and so we know how to contact you if you are the winner. We may later collect other information from you, for example further contact details, including the address to send any prize to.
4. We will only use the personal information we collect from you (Personal Information) to:
(a) manage, monitor and develop the Contest and other contests;
(b) to contact you if you are the winner of the Contest.
Disclosure
5. We may store your Personal Information on computer systems operated by third parties. We will take reasonable precautions against unauthorised access and disclosure by those third parties.
6. We will not share your Personal Information with third parties except:
(a) as required to administer the Contest or provide you with any prize; and

8. Except as otherwise authorised by you, your Personal Information will be retained only for as long as we need it to manage, monitor and develop our contests.

10. We take reasonable precautions to make sure that we keep your Personal Information secure.
11. Because the internet is an open network, we cannot warrant or guarantee that your Personal Information is safe from unauthorised access or use.
12. Where you have authorised us to disclose your Personal Information to a third party, their use and maintenance of your Personal Information is outside our control and we accept no responsibility or liability for such third party use.
13. You may request access to your Personal Information that is held by us and we will delete it or correct it if you ask us to.

14. From time to time we may send you, and you agree to receive, emails and other promotions relating to us, our related companies, or products and emails and other promotions from Kiwis for Kiwi.
15. You may opt out of receiving those emails and other promotions at any time by following the opt-out instructions provided by us or the person sending you the email.

16. We may update this Privacy Policy from time to time. The current version will apply to your entry to the Contest and our use of your Personal Information.
17. The Contest may contain links to third party websites or applications. We are not responsible for the privacy practices or content of third party websites or applications.
18. Your participation in the Contest is also governed by any applicable Terms and Conditions of Entry. Please read these carefully, as you agree to them by your entry to the Contest.
